Generally not. Bavaria's own closing-hours act replaced the federal law on 1 August 2025. According to the social affairs ministry, the basics stay as they were: shops open from 6 am to 8 pm, Monday to Saturday, and close on Sundays and public holidays. The act does not recognise Spätis as a separate type of business, as Munich's Kreisverwaltungsreferat (KVR) pointed out in August 2025.
The KVR states that every kiosk in Munich is first of all a retail business. An operator who also registers and runs a licence-free hospitality business may hand certain goods such as bottled beer, soft drinks, tobacco and sweets for prompt consumption outside curfew hours. That comes from section 7(2) of the Gaststättengesetz, and the KVR's leaflet has the details. It is not a free pass for the whole range.
Which exceptions help Munich retailers?
Art. 7 of the act lets municipalities set up to eight late evenings a year until midnight; Munich lists four shopping nights for 2026, with the next on 27 November and 12 December. In addition, any shop may open until midnight on up to four working days a year. Notify the KVR online at least 14 days ahead; the city says no permit is needed.
Such evenings repay preparation: order about a week ahead and try a carton of something you do not normally stock. Fuel stations and outlets in railway stations may sell travel goods during closing hours, and Munich Airport has a wider permitted range. Newspaper outlets may open for five hours on Sundays between 8 am and 6 pm. Check the law or ask the KVR what applies to your location (as of November 2026).
What about vending machines and unstaffed stores?
Unstaffed micro-supermarkets of up to 150 m² with no personal customer contact may stay open during closing hours; on Sundays and holidays the municipality may set the times, with at least eight consecutive hours. Individual machines outside retail outlets with a limited range are exempt from closing hours.
Watch your staffing: under Art. 9(5) of the Bavarian closing-hours act (BayLadSchlG), employees may not fill or service machines spatially linked to a retail outlet during general closing hours. The same goes for micro-supermarkets, where it also covers sales and cleaning. Exceptions apply under section 10 of the Working Hours Act (ArbZG) where the work cannot be done outside those hours. Which products work for daytime trade?
With an 8 pm finish there is no night trade, so lunch breaks, the end of the school day and the commute home matter all the more. Takis Fuego, Pipapo Knax, AMIGO Ice Tea Lemon and chilled cans such as LOTTE Milkis Strawberry fit those moments. Samyang Buldak Quattro Cheese is more of a take-home buy.

How do Munich retailers order from MDH?
We are not based in Bavaria and supply from Mettmann. For the brands we deal directly with the manufacturers, including Barcel for Takis. Some of our squishies are made to our own order.
Approval requires proof of business and usually takes 1–2 working days. We set no minimum order value; full cartons are all you need. Food matters fall to the KVR's food inspection service, whose staff are spread across the district inspectorates; your business address determines the right office.
