According to the Senate department, Berlin retail outlets may open around the clock from Monday to Saturday but must generally stay closed on Sundays and public holidays. The shop opening act makes exceptions for purely tourist shops (1 pm to 8 pm), for outlets with a special range such as newspapers, flowers or baked goods (7 am to 4 pm), and for fuel stations and sales points in railway stations.
On 22 May 2019 the Berlin Administrative Court ruled (4 K 357.18) that typical Spätis do not qualify: their broad range serves the neighbourhood rather than tourists in particular. An urgent case dated 23 August 2019 (4 L 216.19) went differently. That operator held a restaurant licence and genuinely ran a hospitality business, although retail sales had to stop visibly on Sundays.
In spring 2026 the Berlin Späti association announced plans for a referendum on Sunday opening. As of November 2026 we are not aware of any adopted change to the law. Check your own case with your district's public order office or a lawyer; this page is not legal advice.
How do you time orders around the weekend?
If you close on Sunday, Saturday night is your last chance to sell what is on the shelf. Try to order early in the week. With the usual 24–48 hour window, restocks then tend to arrive before Friday evening, ahead of the point when fridges empty fastest.
Allow extra time before public holidays and long weekends, because we cannot promise delivery on a fixed day. Larger drinks orders can travel on a pallet by freight carrier; check beforehand whether the courtyard or pavement outside your shop allows for that.
Which products suit a Berlin Späti?
Late-night impulse buys call for chilled cans such as Red Bull Glacier Ice Raspberry, LOTTE Milkis and Cantabile Mango Ade, plus Takis in Blue Heat, Fuego and Queso Volcano at eye level. Who handles food inspection in Berlin?
Responsibility lies with the districts' veterinary and food inspection offices, specifically the one covering the area where your shop stands. A Späti in Neukölln therefore deals with Neukölln, one in Pankow with Pankow. New operators settle their registration as a food business there.

How do Berlin retailers open an account?
Registration is online and open to businesses only: upload your Gewerbeanmeldung or commercial register extract, and prices and volume tiers normally become visible after 1–2 working days. No minimum order value applies, and a full carton is the smallest unit.
